1. Agreement to Terms
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity ("you") and Drew Teresh ("we," "us" or "our"), concerning your access to and use of the "Freshly: Food Fresh Tracker" mobile application (the "App") as well as the www.drewteresh.com website. By downloading, accessing, or using the App, you agree that you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree, you are expressly prohibited from using the App and must discontinue use immediately.
2. Use of the Application
We grant you a revocable, non-exclusive, non-transferable, limited right to install and use the App on wireless electronic devices owned or controlled by you, and to access and use the App on such devices strictly in accordance with the terms and conditions of this license. You shall not: (1) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the App; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the App.
3. Food Safety Disclaimer (Important)
Freshly is a tracking utility, not a health or food safety authority. The expiration dates, statuses, and notifications provided by the App are based on the data you enter and general estimations. You acknowledge that food safety depends on various factors including storage conditions, packaging, and temperature.
You must always use your own senses (smell, sight, taste) and judgment to determine if food is safe to consume. We assume no liability for any illness, health issues, or damages resulting from the consumption of spoiled food, regardless of the status displayed in the App.
4. Barcode Scanner and Data Accuracy
The App includes a barcode scanner designed to assist you in quickly entering product details. While we strive to maintain an accurate database, we do not guarantee that the scanner will recognize every product, nor do we guarantee the complete accuracy of the automatically fetched data (names, photos, or default lifespans). You are responsible for verifying and correcting any product information added via the scanner.
5. Expiry Date Recognition (OCR)
The expiry date scanning and automatic recognition feature is provided "as is" solely for your convenience. Due to various factors (print quality, lighting, packaging damage, non-standard formats), the technology may produce inaccurate results. The user bears full and sole responsibility for verifying and confirming the accuracy of the recognized date against the physical product packaging before saving it in the App. The developer assumes no liability for any direct or indirect damages, including food spoilage or health issues, resulting from an incorrectly saved expiry date.
6. In-App Purchases and Subscriptions
The App may offer premium features, virtual items, or subscriptions ("In-App Purchases"). All In-App Purchases are processed and managed entirely by the respective app stores (Google Play Store or Apple App Store) depending on your device.
Billing and Renewals: If you purchase a recurring subscription, your payment will be charged to your app store account at confirmation of purchase. Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. You can manage and cancel your subscriptions by going to your account settings in the Google Play Store or Apple App Store after purchase.
Refund Policy: Because all transactions are processed by Google or Apple, we do not have the ability to process payments, cancel subscriptions, or issue refunds directly. Any requests for refunds must be directed to the respective app store's customer support, and will be governed by their standard refund policies.
7. Data Storage and Backups
The App allows you to store inventory data locally on your device and may offer offline backup features. You are solely responsible for creating and maintaining backups of your data. We are not responsible or liable for any loss or corruption of your data caused by device failure, app deletion, operating system updates, or any other reason.
8. Modifications and Interruptions
We reserve the right to change, modify, or remove the contents of the App at any time or for any reason at our sole discretion without notice. We will not be liable to you or any third party for any modification, price change, suspension, or discontinuance of the App. We cannot guarantee the App will be available at all times. We may experience hardware, software, or other problems or need to perform maintenance related to the App, resulting in interruptions, delays, or errors.
